VoxenAI – Terms & Conditions

These Terms & Conditions (“Terms”) govern your access and use of VoxenAI websites, products, and related services (“Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

  1. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use our Services.

  1. Services Provided

VoxenAI provides AI-powered software and automation solutions, including:

  • AI voice agents
  • AI chat assistants
  • Workflow automation
  • CRM and related tools

Features may evolve or change at any time without prior notice.
We may suspend or discontinue any feature at our discretion.

  1. Accounts & Access

You are responsible for:

  • Providing accurate registration information
  • Securing your login credentials
  • All activity under your account

We may suspend or terminate accounts if we suspect misuse, fraud, or violation of these Terms.

  1. Customer Data

You retain ownership of your data.
You grant VoxenAI a limited licence to store, process, transmit, and analyse your data only for purposes of delivering the Services.

We may use anonymized or aggregated data for analytics, product development, or improvement.

You are responsible for ensuring your data collection and usage comply with applicable laws, including PDPA.

  1. AI Output Disclaimer

Our Services generate automated responses, including voice calls, messages, and content.
We do not guarantee:

  • Accuracy
  • Completeness
  • Legal, financial, or professional suitability

You understand AI output may contain errors or inaccuracies.
You are solely responsible for verifying the accuracy of information before acting on it.

We are not liable for any decisions, losses, or damages resulting from reliance on AI-generated content.

  1. Acceptable Use

You agree NOT to:

  • Use the Services for unlawful, harmful, or fraudulent purposes
  • Send spam, threats, or abusive content
  • Infringe third-party rights
  • Harm or disrupt the platform
  • Misrepresent your identity or AI as a real human for malicious intent

If your use breaches applicable laws (e.g., marketing rules, PDPA), that is your liability, not ours.

We reserve the right to suspend your account if we detect prohibited use.

  1. Marketing & Outreach

If you use VoxenAI for outbound calling or messaging, you are responsible for:

  • Ensuring lawful use
  • Obtaining any required consents
  • Honouring Do-Not-Call (DNC) requests
  • Maintaining subscriber compliance

We provide tools but do not guarantee legal compliance of your usage.

  1. Subscription, Billing & Renewal

Most Services are billed on a subscription basis.

  • Fees are charged upfront
  • Plans renew automatically unless cancelled
  • Prices may change; continued use indicates acceptance

You are responsible for paying all applicable taxes.

  1. Cancellation & Refunds

You may cancel anytime, but:

  • Fees are non-refundable
  • Access continues until end of billing cycle

We may offer refunds only at our sole discretion.

  1. Service Availability

We strive for reliable service but do not guarantee:

  • Uninterrupted operations
  • Real-time delivery
  • Zero latency

Maintenance or outages may occur without notice.

We are not liable for losses due to downtime.

If you need hard guarantees — buy an enterprise SLA. Otherwise, don’t complain.

  1. Third-Party Services

Our Services may integrate with third-party platforms (e.g., WhatsApp, CRM, telephony etc).

We are not responsible for:

  • Their availability
  • Data handling
  • Pricing
  • Policy changes

Your relationship with those providers is separate.

  1. Intellectual Property

All rights in the Services, including software, algorithms, design, and trademarks, belong to VoxenAI and licensors.
You receive a limited, non-exclusive, non-transferable licence to use the Services for your business use only.

You may not:

  • Copy
  • Reverse engineer
  • Resell
  • Publish
  • Create derivatives
  1. Termination

We may terminate or suspend access if you:

  • Breach these Terms
  • Misuse the Services
  • Fail to pay

You may terminate by stopping use + canceling subscription.
Upon termination, your access stops but clauses on IP, liability, and indemnity survive.

  1. Limitation of Liability

To the fullest extent permitted by law:
VoxenAI is not liable for:

  • Direct, indirect, incidental, consequential, or special damages
  • Loss of revenue, data, business, or profits
  • Issues caused by AI output, outages, third-party platforms, or misuse

Total liability shall not exceed the fees paid in the last 3 months.

  1. Indemnity

You agree to defend, indemnify, and hold VoxenAI harmless from claims, damages, losses, and liabilities arising from:

  • Your use of the Services
  • Your breach of these Terms
  • Your violation of laws, PDPA, DNC rules, or rights of others
  1. Governing Law

These Terms are governed by the laws of Malaysia.
Disputes are subject to Malaysian courts’ jurisdiction.

  1. Changes to Terms

We may update these Terms anytime.
Continued use means acceptance of updates.
